Topic: Commercial Tenancy

We represented the owners of a coffee shop who were having difficulty with their landlord.  When negotiations failed to settle their differences, the landlord brought an action for eviction against the coffee shop.

The action for eviction was based on alleged violations of the lease and raised novel legal issues about whether the landlord’s prior conduct negated, or lessened the impact of, certain provisions in the lease.  The case was tried in the Superior Court of New Jersey, Passaic County, Special Civil Part.  At the end of trial, the Judge reserved decision pending receipt of post-trial briefs.  The Judge issued a written opinion finding in favor of our Clients, the coffee shop owners.
